PLEASE, TAKE NOTICE that, John Murtari, the defendant herein, pursuant to CPLR 5601(b)(1), appeals to the Court of Appeals from an order of the Appellate Division, Fourth Department, entered in the office of the Clerk of the Appellate Division on April 29, 1998, and which order unanimously affirmed the Judgment and Decree of Divorce made in this action, on the 26th day of March, 1997, by the Honorable Charles T. Major, Justice of the Supreme Court, and entered in the office of the clerk of Onondaga County, on the 3rd day of April, 1997, and which order finally determines this action in which there is directly involved the construction of the provisions of 5^th, 7^th, 9^th, and 14^th, Amendments to the Constitution of these United States.

PLEASE TAKE FURTHER NOTICE that, John Murtari, the defendant herein, appeals from each and every part of that order of the Appellate Division, as well as from the whole order.
