- Whether the CPLR and Domestic Relations Law (DLR) of the State of New York violate the
Federal Constitution when they prohibit a party in a divorce action from having a jury
make a determination on the issue of child custody.
- Whether the CPLR and Domestic Relations Law (DLR) of the State of New York violate the
Federal Constitution when they do not guarantee a parent the right to representation by
Counsel in a proceeding where the custody of their children is at issue.
