QUESTIONS PRESENTED

  1. Whether the CPLR and Domestic Relations Law (DLR) of the State of New York violate the Federal Constitution when they prohibit a party in a divorce action from having a jury make a determination on the issue of child custody.
  1. Whether the CPLR and Domestic Relations Law (DLR) of the State of New York violate the Federal Constitution when they do not guarantee a parent the right to representation by Counsel in a proceeding where the custody of their children is at issue.
  1. Whether the CPLR and Domestic Relations Law (DLR) of the State of New York violate the Federal Constitution when they prohibit a party in a divorce action from having a jury make a determination on the issue of property distribution.
